Alleged kidnap: Court orders arrest of Bayelsa top politician, two others

A Federal High Court in Abuja has ordered the arrest of a top politician, Honourable Israel over February 24 abduction of Deputy Commissioner of Police (DCP), Kola Okunlola in Bayelsa State.
DCP Okunlola, in charge of the Federal Special Anti- Robbery Squad, was said to have been abducted in Brass, Bayelsa State while he was monitoring the last Presidential and National Assembly elections.
Goli, who was a House of Representatives candidate in the last election, was accused of coordinating the abduction.
Also to be affected by the arrest warrant issued on Wednesday by Justice Okon Abang, are Goli’s alleged accomplices – Victor Tamarapreye (male, 34yrs) and Azi Newton (male, 34 yrs).
Justice Abang, in a ruling on an application by Simon Lough (representing the Inspector General of Police) ordered that the three, listed with eight others as defendants in a charge pending before the court, be arrested anywhere they are found in the country.
Lough had attended court in respect of a five-count charge filed in the name of the Inspector General of Police (IGP), in which the 11 were charged under the Prevention of Terrorism Act over their complicity in Okunola’s abduction.
When the charge, marked: FHC/ABJ/CR/53/2019 was called, Lough told the court that, even when Goli, Tamarapreye and Newton were served with the charge and informed about the March 20 date, they neither attend court nor sent lawyers.
Lough then prayed the court to issue arrest warrant on the three defendants, who have been served with the charge, to facilitate their production in court.
In response to the judge’s observation that the prosecution has the capacity to ensure the arrest and production of the defendants in court, Lough said the order from court will make the task easier.
Upon being satisfied with Lough’s submission, Justice Abang said although it was not mandatory for the court to issue bench warrant on a defendant yet to be properly arraigned before the court, he was inclined to exercise his decretion in favour of the prosecution in view of the nature of the charge.
Justice Abang noted that sections 113 and 394 of the Administration of Criminal Justice Act (ACJA), on which Lough relied to make his application, did not make the grant of bench warrant mandatory.
He said: “However, having considered the nature of the charge, I am inclined to exercise my jurisdiction in favour of the prosecution in granting the order sought.
“In the light of this, the application of the learned counsel for the prosecution deserves to succeed and it is accordingly granted as prayed.
“Bench warrant is hereby ordered to be issued for the arrest of Hon Israel Sunny Goli ‘m’ 47yrs, Victor Tamarapreye ‘m’ 34yrs and Azi Newton ‘m’ 34 yrs, anywhere they are found within the country Nigeria to be arraigned on 27th of March 2019.
“The judge adjourned to March 27 this year and ordered that hearing notices be issued on the defendants.
The eight others listed in the charge are: Abiye Bob ‘m’; Kingsley Alex ‘m’ (aka Cmaru); Clement Ayibatonye, Jonathan Hart ‘m’, Sammy Newman ‘m’, Sam Kojo ‘m’, Pipi Ogiri ‘m’, Soldier Akwe (now at large).
The five-count charge reads:
*That you Hon. Israel Sunny Goli ‘m’ 47yrs of No 65 Imgbi Road, Yenagoa; Victor Tamarapreye ‘m’ 34yrs of Prosco Road Yenagoa; Azi Newton ‘m’ 34 yrs of Goodnews Street, Yenagoa and Abiye Bob ‘m’; Kingsley Alex ‘m’ (aka Cmaru); Clement Ayibatonye, Jonathan Hart ‘m’, Sammy Newman ‘m’, Sam Kojo ‘m’, Pipi Ogiri ‘m’, Soldier Akwe (now at large) on or about 24th February, 2019 at Brass in Bayelsa State within the jurisdiction of this court, while acting in concert, conspired together to commit felony to wit: acts of terrorism and thereby committed an offence contrary to Section 17 of the Terrorism (Prevention) Amendment Act 2013.
*That you Hon. Israel Sunny Goli ‘m’ 47yrs of No. 65 Imgbi road Yenagoa, Victor Tamarapreye ‘m’ 34yrs of Prosco road Yenagoa, Azi Newton ‘m’ 34yrs of Goodnews Street Yenagoa; and Abiye Bob ‘m’, Kingsley Alex ‘m’ (aka Cmaru), Clement Ayibatonye, Jonathan Hart ‘m’, Sammy Newman ‘m’, Sam Kojo ‘m’, Pipi Ogiri ‘m’, Soldier Akwe (now at large) on or about 24th February, 2019 at Brass in Bayelsa State, within the jurisdiction of this court, while acting in concert, seized and detained Dcp Kola Okunlola, who was on special duty in Brass for the Presidential and National Assembly elections, and threatened to kill him in order to compel him to call back to Brass the electoral officer in charge of the Brass collation centre and thereby committed an offence contrary to and punishable under section 15(1)(b) of prevention of terrorism Act 2013.
*That you Hon. Israel Sunny Goli ‘m’ 47yrs of No. 65 Imgbi road Yenagoa, Victor Tamarapreye ‘m’ 34yrs of Prosco road Yenagoa, Azi Newton ‘m’ 34yrs of Goodnews Street Yenagoa; and Abiye Bob ‘m’, Kingsley Alex ‘m’ (aka Cmaru), Clement Ayibatonye, Jonathan Hart ‘m’, Sammy Newman ‘m’, Sam Kojo ‘m’, Pipi Ogiri ‘m’, Soldier Akwe now at large on or about 24th February, 2019 at Brass in Bayelsa State, within the jurisdiction of this court, while acting in concert, seized, detained Dcp Kola Okunlola, who was on special duty in Brass for the Presidential and National Assembly elections, and disposed him of his beret, belt, shoes, uniform, wristwatch, godgets and N14,000.00 cash and thereby committed an offence contrary to and punishable under Section 15(1)(a) of Prevention of Terrorism Act 2013.
*That you Hon. Israel Sunny Goli ‘m’ 47yrs of No. 65 Imgbi road Yenagoa, on or about 24th February, 2019 at Brass in Bayelsa State, within the jurisdiction of this court, aided and abetted the commission of act of terrorism which was eventually committed when you induces and instigates Victor Tamarapreye ‘m’ 34yrs of Prosco Road Yenagoa, Azi Newton ‘m’ 34yrs of Goodnews Street Yenagoa; and Abiye Bob ‘m’, Kingsley Alex ‘m’ (aka Amaru), Clement Ayibatonye, Jonathan Hart ‘m’, Sammy Newman ‘m’, Sam Kojo ‘m’, Pipi Ogiri ‘m’, Soldier Akwe to attack and seize DCP Kola Okunlola, who was on special duty in Brass for the Presidential and National Assembly elections, and they seized, detained and inflicted injuries on him and you thereby committed an offence contrary to Section 18 of Prevention of Terrorism Act 2013.
