The Ogbia Division of the Bayelsa State High Court sitting in Yenagoa has upheld the decision of Governor of Bayelsa State, His Excellency, Senator Douye Diri, for removing the Chairman of the Otuokpoti Community Development Committee (CDC), Mr. Anthony Azibalua, on grounds of procedural irregularities in the suit challenging the action.
Delivering judgment on Tuesday, October 21, 2025, in Suit No. BYHC/OHC/CV/29/2024, Hon. Justice (Dr.) S.W. Amaduobogha held that the claimant adopted a wrong mode of commencing the action, adding that the court, therefore lacked the jurisdiction to entertain the matter.
Mr. Azibalua, the former CDC Chairman, had approached the court through an Originating Motion, seeking an Order of Certiorari to nullify his removal from office by Governor Diri.
In its ruling, the court struck out the case and dismissed all reliefs sought by the claimant, effectively affirming the Governor’s action.
Reacting to the judgment, the Honourable Attorney-General and Commissioner for Justice, Mr. Biriyai Dambo, SAN, lauded the ruling, describing it as a well-considered decision. He emphasized that the Governor’s actions are consistently guided by the principles of peace, order, for the overall progress of the Bayelsa State.
Mr. Dambo, SAN further reiterated that the Prosperity Administration under Governor Diri maintains a zero-tolerance stance against acts capable of undermining the peace and stability of communities across the state.
